Focus and Scope

USROTUNA: Journal of Islamic Family Law and Islamic Family Ethics is an academic journal focusing on the study of Islamic family law and Islamic family ethics from normative, empirical, social, cultural, and contemporary perspectives. The journal provides an academic platform for the development of scholarly thought, research, and discourse on the dynamics of Muslim families and the responses of Islamic law to various family-related issues in society.

USROTUNA: Journal of Islamic Family Law and Islamic Family Ethics welcomes research articles, conceptual studies, literature reviews, and critical studies that contribute academically to the development of Islamic family law and Islamic family ethics. Submissions may employ approaches from Islamic law, fiqh, usul al-fiqh, maqasid al-shari'ah, positive law, sociology of law, anthropology, gender studies, family psychology, and other interdisciplinary approaches.

Scope

The scope of the journal includes, but is not limited to, the following areas:

  1. Islamic Marriage Law, including marriage contracts, pillars and conditions of marriage, guardianship, dowry, polygamy, interfaith marriage, and contemporary issues related to marriage.
  2. Divorce and Family Dispute Resolution, including talaq, khul', fasakh, mediation, litigation and non-litigation mechanisms, and the resolution of family conflicts based on Islamic law and positive law.
  3. Rights and Responsibilities within the Family, including husband-wife relations, children's rights, financial maintenance, family responsibilities, and the distribution of roles within the household.
  4. Islamic Inheritance and Family Property Law, including inheritance, wills, gifts, joint marital property, family endowments (waqf), and the management of family wealth.
  5. Protection of Women and Children in Islamic Law, including domestic violence, child marriage, child protection, reproductive rights, and issues of justice and equality within the family.
  6. Islamic Family Ethics, including moral values, responsibility, compassion, justice, reciprocity (mubadalah), communication, and the development of families characterized by sakinah, mawaddah wa rahmah.
  7. Fiqh of Marriage and the Development of Islamic Family Law, including studies of classical and contemporary fiqh literature and the reform of Islamic family law.
  8. Maqasid al-Shari'ah and Islamic Family Law, particularly the application of principles of public benefit (maslahah), justice, and the protection of life, lineage, intellect, wealth, and human dignity in family-related matters.
  9. Islamic Family Law and Positive Law, including the relationship between Islamic law, legislation, court decisions, government policies, and family law practices in various countries.
  10. Muslim Families from Social and Cultural Perspectives, including social change, local traditions, marriage customs, Muslim families in modern society, and the interaction between religious norms and social realities.
  11. Contemporary Issues in Islamic Families, including assisted reproductive technology, digital marriage and relationships, families in the digital era, migration, transnational families, changing family structures, and family-related issues arising from technological developments.
  12. Gender and Family Relations, including gender constructions within the family, power relations, reciprocity between spouses, gender justice, and the reinterpretation of Islamic texts concerning family and gender relations.
  13. Psychology, Education, and Resilience of Muslim Families, including family education, parenting, healthy family relationships, family resilience, and character development based on Islamic values.
  14. Comparative Islamic Family Law, including comparative studies of legal schools (madhahib), countries, legal systems, and family law practices among Muslim communities in different regions.
  15. Islamic Thought and Textual Studies on Family, including studies of the thoughts of Muslim scholars and intellectuals, as well as critical analyses of the Qur'an, Hadith, classical fiqh texts, and other literature on Islamic family law and ethics.

USROTUNA welcomes research that develops new perspectives, interdisciplinary approaches, and dialogue between Islamic intellectual traditions and developments in law, society, culture, and technology. All submissions are expected to demonstrate strong academic foundations, clear methodology, critical argumentation, and significant contributions to the development of Islamic family law and Islamic family ethics.
